Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Western Australia, Australia.
By clicking “Buy Now,” “Purchase,” or any other phrase on the purchase button, entering your credit card information, or otherwise enrolling – electronically, verbally, or otherwise enrolling in any program, training, event, retreat, VIP day/weekend, intensive, or coaching container (“Program”) offered by Kate Wilkinson Creative (“we,” “our,” or “the Company”) – you (“Client”) agree to the following Terms and Conditions:
1. Payment Terms and Refund Policy
All payments are final and non-refundable. By completing checkout, the Client agrees to honour their payment commitment and is legally obligated to pay for the program in full, regardless of whether they choose to complete, participate in, or access the program.
Due to the digital nature and delivery format of our products and services, we do not offer refunds if you change your mind or are unable to participate for any reason.
Chargebacks will not be accepted. Initiating a chargeback without prior written communication may be considered a breach of this agreement and will result in legal recourse and/or collections action.
2. Missed or Failed Payments
In the event of a missed instalment, you will receive an email with a 72-hour grace period. If the payment is not made within 5 business days, your access to the program may be suspended or terminated without refund, including access to modules, materials, and coaching calls.
If a payment remains overdue, a 5% late fee may be added to the outstanding amount. Accounts with multiple failed attempts may be referred to collections.
3. Refund Policy
By enrolling in any Kate Wilkinson Creative program or purchasing any offer, you agree you are responsible for the full cost, including remaining instalments, even if you decide not to complete the program.
We do not issue refunds under any circumstances unless required by Australian Consumer Law.
4. Medical, Legal & Financial Disclaimer
Our coaching, programs, and services are intended for educational and informational purposes only. They do not constitute legal, financial, medical, psychological, or psychiatric advice.
We do not diagnose, treat, cure, prevent, or guarantee any medical, legal, or financial outcomes.
5. No Guarantees of Results
Your outcomes are not guaranteed. Success depends on many factors, including your personal effort, business model, market conditions, and timing.
By enrolling, you take full responsibility for your results and understand that testimonials or case studies are not promises or guarantees.
6. Coaching Sessions and Punctuality
Sessions are to be attended at the scheduled time. If you arrive late, the Coach is not required to extend the session. Any delay of more than 5 minutes is considered a “no-show”, and the session will be forfeited without rescheduling.
7. Communication & Boundaries
Communication (including via Telegram, Voxer, email, or KateWilkinsonPrograms.com) will be responded to during business hours Monday to Friday. Telegram is checked at least twice daily, with final responses sent by 2:00 PM AWST on Fridays.
You agree to treat all team members, contractors, and other clients with courtesy and professionalism. Abuse, harassment, or disrespect may result in immediate removal from the program without refund.
8. Intellectual Property Protection and Personal Use
All materials provided by Kate Wilkinson Creative – including but not limited to trainings, eCourses, templates, videos, documents, and graphics – are protected by Australian intellectual property law.
You may not duplicate, share, sell, or distribute any content, nor may you share your login details with any third party. Doing so will result in immediate termination of access without refund.
9. Recording & Redistribution of Calls
Group coaching calls, masterclasses, and live workshops may be recorded. These recordings may be reused, repurposed, or sold as part of future products or offerings. By participating, you consent to being recorded.
10. Events, Retreats, and VIP Experiences
By enrolling in or attending any in-person experience (retreats, events, intensives, etc.), you acknowledge and agree:
• You are responsible for your own travel, insurance, and personal expenses.
• You voluntarily participate and assume full risk for any illness, injury, or incident.
• Kate Wilkinson Creative is not liable for third-party services (accommodation, transportation, spa services, etc.).
• You agree to settle all incidental charges with the venue directly.
11. Termination
We reserve the right to terminate your access to any Program or service if:
• You fail to make timely payments
• You breach these terms
• You engage in behaviour that disrupts the learning environment or harms other participants
Termination will occur without refund.
12. Governing Law and Jurisdiction
This Agreement is governed by and shall be construed in accordance with the laws of Western Australia. Any disputes shall be resolved exclusively in the courts of Western Australia.
